Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Recommended Motion: Approve the Minutes as presented.

Prior Approved Items

Prior Approved: Approval to apply for the Wolf Depredation Compensation and Financial Assistance County Grant Program. - BOCC

Background:  The Oregon Department of Agriculture has established and implemented a wolf depredation compensation and financial assistance grant program for depredation reimbursement and the implementation of livestock management techniques or nonlethal wolf deterrence techniques designed to discourage wolf depredation of livestock. The current grant cycle is open February 3, 2020 through February 23, 2020. The intent at this time is to request grant funds of $11,876.00 for non-lethal deterrents and compensation for death or injury to livestock. To be eligible the County will need to provide a 10% match for monies requested ($1,187.60 from General Fund)

Fiscal Impact:  $1,187.60 from General Fund for the required 10% match.

Recommended Motion: Motion was made and approved in the 2/18/20 Administrative Meeting to approve the County to apply for $11,876.00 from the Wolf Depredation Compensation and Financial Assistance County Grant Program, and authorize Donnie Boyd to sign application. Fiscal Impact: $1,187.60 from General Fund for the required 10% match.

In the matter of accepting and executing the notice of award for the quote from Angelo Doveri & Son for Construction Services-Crane Services for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project. Jeremy Morris, Public Works

Background:  On January 21, 2020 Public Works requested written quotes for Construction Services – Crane Services for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  The following quotes were received:

Angelo Doveri & Son $10,160.00
Vernam Crane $15,400.00

Public Works requests that the quote be awarded to Angelo Doveri & Son for $10,160.00.

Fiscal Impact:  Fiscal Impact is none.

Recommended Motion:  Board to approve and execute the attached Notice of Award to Angelo Doveri & Son for Construction Services-Crane Services for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  Fiscal impact is none.

In the matter of accepting and executing the notice of award for the quote from Bob’s Excavating for Construction Services-Underground Construction for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project. Jeremy Morris, Public Works

Background:  On January 21, 2020 Public Works requested written quotes for Construction Services – Underground Construction for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  Originally, this work was intended to be completed by KCPW staff, but detailed constructability review showed it to be inefficient for KCPW to construct the work with the type of equipment we have on hand.  The following quotes were received:

Upper Rogue Excavation  $60,673.00
Bob’s Excavating         $50,890.00
Rocky Mountain Construction, LLC  $62,680.00

Public Works requests that the quote be awarded to Bob’s Excavating for $50,890.00.

Fiscal Impact:  Fiscal Impact is none.

Recommended Motion:  Board to approve and execute the attached Notice of Award to Bob’s Excavating for Construction Services-Underground Construction for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  Fiscal impact is none.

Background:  On January 23, 2020 Public Works requested written quotes for Construction Services – Guardrail Supply and Installation for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  The following quotes were received:

Gage-it Construction $12,579.56
Coral Construction $29,984.00

Public Works requests that the quote be awarded to Gage-it Construction for $12,579.56.

Fiscal Impact:  Fiscal Impact is none.

Recommended Motion:  Board to approve and execute the attached Notice of Award to Gage-it Construction for Construction Services-Guardrail Supply and Installation for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  Fiscal impact is none.

In the matter of executing a bid award for Weed Control Chemicals 2020. Todd Pfeiffer, Weed Control

Background: Klamath County Public Works requested quotes for the above referenced project.  The following quotes were received:

Nutrien Ag Solutions     $54,089.83
Wilbur-Ellis     $57,194.65

Public Works recommends awarding the bid to Nutrien Ag Solutions for $54,089.83.

Fiscal Impact:  $45,934.20 expenditure to the Public Works Operating Budget and $8,155.63 to the Weed Control Operating Budget.

Recommended Motion:  Board approve and Execute attached bid award to Nutrien Ag Solutions.  The fiscal impact is $45,934.20 from the Public Works Operating Budget and $8,155.63 from the Weed Control Operating Budget.

Orders

1.

In the matter of reappointing Lisa Longbotham to the Jack Pine Village Special Road District Board. - BOCC

Background: The Jack Pine Village Special Road District Board has a vacancy and has recommended the reappointment of Lisa Longbotham.  Ms. Longbotham is willing, able and eligible to serve another term on the Board commencing January 13, 2020 and expiring December 31, 2022.

Fiscal Impact: None.

Recommended Motion: Approve and sign the attached Order appointing Lisa Longbotham to the Jack Pine Village Special Road District Board.

2.

In the matter of vacating Lots 12 and 19 of Block 2 Tract 1034 Lakewoods Subdivision Unit No. 1. Map No. R-3805-005B0 Tax Lots: 02600 and 02800. Erik Nobel, Planning Director CDD / Planning

Background:  The property owners of the two lots are David and Margaret Bell who have signed a petition requesting this action.  Vacating the lots will not be detrimental to the public.  The Planning Director’s Report recommends that the two lots be vacated from the subdivision. The applicant paid the $583 application fee to process the request to vacate the lots.  Approval of the final order by the Board of Commissioners has no fiscal impact to the county.

Fiscal Impact:   There is no fiscal impact to Klamath County.

Recommended Motion:   Approve the Final Order to vacate the above described property located in Klamath County Oregon. (File No. LV 22-19).  There is no fiscal impact to Klamath County.

Agreements

1.

In the matter of an agreement between Klamath County and the Klamath Community College Foundation DBA Klamath IDEA to promote economic development. Vickie Noel - Finance

Background:  During the September 24, 2020 public Finance meeting, the Klamath County Board of Commissioners authorized $12,500 to Klamath IDEA to assist in funding the entrepreneur-focused economic development plan.  A contract for services is now signed by the Klamath Community College Foundation Board Chair and presented for signature by the Klamath County Board of Commissioners.

Fiscal Impact:  $12,500 expenditure to Economic Development Fund in FY 2019-2020.

Recommended Motion:  Record approval and sign the contract with Klamath Community College Foundation DBA Klamath IDEA to promote economic development.  Fiscal impact of $12,500 expenditure to the Economic Development Fund in FY 2019-2020.

2.

In the matter of accepting and authorizing Board Chair and Finance Director to sign the 2019-2021 CFA/VOCA grant agreement and Exhibits, Eve Costello, DA

Background: The District Attorney’s Office has been awarded the 2019-2021 VOCA/CFA grant. This grant is for funding direct services to victims of crime. Those services are to (1) Respond to emotional, psychological, or physical needs of crime victims; (2) Assist victims to stabilize their lives after victimization; (3) Assist victims to understand and participate in the criminal justice system; and (4) Restore a measure of security and safety for the victim. Funding for this grant is to be used to maintain personnel for mandated services. The project period for this grant is 10/1/19 – 9/30/21 (24 months).

Fiscal Impact: Revenue increase of $329,236.15 in Special Enforcement Budget. There is a General fund cash match of $51,256.98, and an in-kind match of $31,053.02.

Recommended Motion: Accept and authorize Board Chair and Finance Director to sign the 2019-2021 CFA/VOCA grant agreement; “Exhibit A” Certifications Regarding Lobbying, Debarment, Suspension and Other Responsibility Matters, and Drug-Free Workplace Requirements; “Exhibit B” Standard Assurances; “Exhibit C” Single Audit Certification Letter; “Exhibit D” Certification of Compliance with Regulations, Office for Civil Rights, Office of Justice Programs for Subgrants issued by the Oregon Department of Justice; and “Exhibit E” Victims of Crime Act Special Conditions. Fiscal impact is Revenue increase of $329,236.15 in Special Enforcement Budget. There is a General fund cash match of $51,256.98, and an in-kind match of $31,053.02.

In the matter of executing the contract between Klamath County and Bob’s Excavating, Inc. for Construction Services-Underground Construction for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project. Jeremy Morris, Public Works

Background:  This contract provides underground construction services for existing bridge demolition, subgrade preparation, storm drain construction and erosion control in support of KCPW internal staff efforts for bridge construction. 

Fiscal Impact:  $50,890.00 expenditure to the Road Operating Budget.
 
Recommended Motion:  Board to approve and sign the contract between Klamath County and Bob’s Excavating, Inc. for Construction Services-Underground Construction for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  Fiscal impact is $50,890.00 expenditure to the Road Operating Budget.

In the matter of executing the contract between Klamath County and Gage-it Construction for Construction Services-Guardrail Supply and Installation for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project. Jeremy Morris, Public Works

Background:  This contract provides guardrail supply and installation in support of KCPW internal staff efforts for bridge construction.  Public Works is asking for an exception to the insurance requirements of Aggregate Commercial General Liability in the amount of $3M (vs the required $4M).  This is a cost savings of $8,000.00.  The work is estimated to take one business day and under road closure traffic control.

Fiscal Impact:  $12,579.56 expenditure to the Road Operating Budget.

Recommended Motion:  Board to approve, authorize the insurance requirement exception and sign the contract between Klamath County and Gage-it Construction for Construction Services-Guardrail Supply and Installation for the Bridge 35C215 Replacement, Joe Wright Rd/A-3 Canal project.  Fiscal impact is $12,579.56 expenditure to the Road Operating Budget.

Extension Service District

1.

In the Matter of approval of an agreement between Klamath County Extension Service District and ZCS Engineering and Architecture, Inc. Vickie Noel - Finance

Background: Klamath County Extension Service District purchased land located at the corner of South 6th and Hilyard Ave for the purpose of building a New Community Outreach Center.  This agreement with ZCS Engineering will provide architectural design and engineering services to continue with the building of this project. Agreement expires on June 30, 2022 with (2) additional one (1) year terms if required.

Fiscal Impact: $308,740.00 Expenditure to the Klamath County Extension Service District Building Reserve fund.

Recommended Motion:  Motion to approve agreement between Klamath County Extension Service District and ZCS Engineering and Architecture, Inc.  Fiscal impact is $308,740.00 expenditure to the Extension Service District building reserve fund.
